These Terms of Service, together with our Privacy Policy and the marketplace policies referenced below, form the agreement governing your use of the CardBuster marketplace.
Authentication methods, including Facebook Login, are part of your CardBuster account and are governed by these Terms and our Privacy Policy.

1. Introduction and Changes to These Terms
These Terms of Use (Terms), together with our Privacy Policy, Trade Policy, Return & Refund Policy, Seller Fees and Charges, Condition Guide, FAQ, and all other policies referenced herein, form the complete agreement governing your use of the CardBuster marketplace. We incorporate these policies by reference as if fully set out herein.
We may modify these Terms at any time. The modified Terms will be posted on the CardBuster website or mobile application. Your continued use of CardBuster following any modification constitutes your acceptance of the modified Terms. We will notify users of material changes via email or prominent notice on the platform. If you do not agree to the modified Terms, you must discontinue use of CardBuster.
2. About CardBuster Marketplace
CardBuster is an online marketplace facilitating the buying and selling of trading card game (TCG) products, including individual cards, sets, sealed products, and related items. Users may list products for sale, place purchase orders, and engage in fixed-price buy-now transactions.
CardBuster operates as an intermediary and commercial agent but does not itself act as a buyer or seller. Contracts for the sale of products are entered into directly between buyers and sellers. We facilitate these transactions through our platform but are not a party to any sales agreement. Each buyer and seller is responsible for all aspects of the transaction, including condition assessment, pricing, payment, and fulfillment.
Our marketplace operates using the Standard Product Unit (SPU) model, allowing users to buy cards individually or in bundles at fixed prices. Buyers may aggregate purchases across multiple sellers in their cart and complete the transaction in one checkout. Age Requirements: CardBuster is available only to users aged 18 and older. Users under 18 must obtain the consent and supervision of a parent or legal guardian. By using CardBuster, you represent that you are at least 18 years of age (or have parental consent if under 18) and that you are legally capable of entering into binding contracts in your jurisdiction.
3. Accounts, Passwords, and Security
To access CardBuster, you must create an account and maintain a valid, active user profile. You are responsible for providing accurate, current, and complete information and for maintaining the confidentiality of your account credentials (username, password, and authentication methods). Your account is personal and non-transferable. You agree not to share your credentials or permit others to use your account.
You are solely responsible for all activity that occurs under your account, including unauthorized access. If you suspect unauthorized use or breach of your account, notify CardBuster immediately at contact@cardbuster.com. CardBuster may require identity verification, including government-issued identification, to activate your account or elevate account privileges. Providing false information, impersonating others, or operating multiple accounts in violation of our policies may result in account suspension or permanent termination.
4. Fees, Taxes, and Payment
CardBuster charges fees for the use of the marketplace. Fees applicable to sellers are described in our Seller Fees and Charges policy, which is incorporated by reference and sets out all applicable transaction fees, commission rates, payment processing fees, and other charges. Sellers are responsible for all taxes, including income tax and applicable consumption taxes (SST in Malaysia), arising from their sales on CardBuster.
Buyers are responsible for paying all applicable sales taxes, goods and services taxes, and other taxes imposed by law in their jurisdiction. CardBuster may be required by applicable law to collect and remit Sales and Service Tax (SST) in Malaysia on transactions. Buyers acknowledge that taxes may be added to purchase prices at checkout or collected separately.
Payment for purchases is processed through approved third-party payment processors. By completing a purchase on CardBuster, you authorize us and our payment processors to charge your selected payment method (credit card, debit card, digital wallet, or other approved method) for the full purchase price, including applicable fees and taxes. You agree to comply with the terms and conditions of your payment method provider.
Refunds, where due, are executed by these same third-party payment processors and credited to the Buyer’s original payment method. Refund processing time after CardBuster’s initiation is determined by the payment processor, the relevant card scheme, and the Buyer’s issuing bank or e-wallet operator, and is outside CardBuster’s control. Indicative timing and the limits of CardBuster’s responsibility are set out in Section 8 of the Return & Refund Policy.

5. Trade Policy
All buying and selling on CardBuster is governed by our Trade Policy, which establishes binding rules and procedures for transactions. Sellers must dispatch all items within the timeframe specified in the Trade Policy. Buyers have the right to cancel orders under the conditions set out in the Trade Policy and may not cancel without lawful cause after a seller has begun fulfillment.
Any disputes arising from transactions—including allegations of non-delivery, item condition mismatches, defective goods, or seller non-performance—are resolved exclusively in accordance with our Trade Policy and Return & Refund Policy. Our dispute resolution process employs a fault-based liability model, meaning remedies (refunds, cancellations, or replacements) are determined based on the responsible party's failure to meet their obligations. In exceptional condition disputes, CardBuster may direct an expert pre-grading assessment of the disputed card, on the PSA standard, by an approved independent collection agent, in accordance with Section 7.7 of the Condition Guide; the assessment is conclusive of the card’s condition.

Each transaction is subject to a maximum of two platform decision points as defined in the Trade Policy and Return & Refund Policy. After the applicable decision point(s) have concluded, the ruling is final and binding. No further platform-level dispute mechanisms are available. Users retain the right to pursue legal remedies through courts of competent jurisdiction or through the binding arbitration agreement set out in these Terms.
6. Counterfeits, Fraud, and Market Manipulation
CardBuster maintains a zero-tolerance policy on counterfeit, fraudulent, stolen, or misrepresented items. Sellers warrant that all items listed are authentic, legally owned, and accurately described. Buyers must notify CardBuster of suspected counterfeits or fraud within the timeframe specified in the Trade Policy.
Upon discovery of counterfeit items, fraudulent activity, market manipulation, wash trading, price fixing, or other misconduct, CardBuster reserves the right to take any or all of the following actions, at its sole discretion:
- Remove listings and cancel orders
- Withhold payments pending investigation
- Restrict seller privileges, including delisting authority
- Charge the seller's registered payment method for investigation costs, remediation, or customer refunds
- Suspend or permanently ban the account and linked accounts from the platform
- Prevent re-registration using linked email addresses, payment methods, phone numbers, or device identifiers
- Report counterfeit or fraudulent items to law enforcement and provide evidence upon request
- Destroy counterfeit items or cooperate with authorities in their disposition
Sellers agree that these remedies are reasonable and proportionate to the seriousness of counterfeit and fraudulent conduct. CardBuster will exercise these rights in accordance with applicable law and may pursue civil or criminal remedies against responsible parties.
7. Seller Obligations
By listing an item on CardBuster, a seller makes a binding offer to sell that item at the listed price, subject to these Terms and the Trade Policy. Sellers must ensure items are in stock, accurate in description, and genuinely available for immediate fulfillment.
Sellers must dispatch all sold items within the timeframe specified in the Trade Policy. Dispatching may be done using CardBuster's provided shipping labels or through alternative logistics arrangements, provided the seller supplies a valid tracking number or airway bill (AWB) for shipment verification. Sellers are responsible for proper packaging and protection against damage in transit. Risk of loss or damage in transit, and any shipping-carrier claims, are allocated under the Trade Policy and the Return & Refund Policy (including Return & Refund Policy Section 14, Carrier Claims). Where a CardBuster-integrated carrier is used, CardBuster is the shipper of record for the purpose of any carrier claim, and the Seller cannot claim against that carrier directly.
All items must be accurately described in accordance with CardBuster's Condition Guide, which defines standardized condition grades and descriptors. Sellers warrant that items match their stated condition upon listing. The condition a seller has represented is determined from the final listing as a whole: where the selected condition tier conflicts with the listing photographs or written description, the photographs and description prevail and constitute the seller’s binding condition representation, as set out in Section 7.2 of the Condition Guide. Sellers must keep the selected tier, photographs, and description consistent, and must amend any confirmed mislabelling within the time notified by CardBuster; repeated confirmed mislabelling results in warnings and penalty points under the Seller Credit Point Policy. Any deviation—such as undisclosed damage, wear, marking, or defect—constitutes a breach of the listing description and may result in dispute, return, refund, and account penalties.
Sellers acknowledge that CardBuster is a marketplace intermediary only and does not authenticate, guarantee, or provide warranty for listed items. Sellers are solely responsible for item authenticity and condition. Failure to fulfill orders, dispatch within the specified timeframe, or maintain accurate listings may result in charges assessed against the seller's payment method, commission increases, account restrictions, or suspension in accordance with the Trade Policy.
8. Buyer Obligations
Buyers must complete payment for items within the timeframe specified in the Trade Policy. By completing checkout, buyers enter into a binding contract to purchase the selected items at the listed price. Cancellation of binding purchase orders is permitted only under the conditions set out in the Trade Policy and is not available as a matter of discretion once the seller has begun fulfillment.
Buyers must provide accurate delivery addresses, including full name, street address, postal code, city, and country. CardBuster cannot be held responsible for delivery failure resulting from incomplete or incorrect address information provided by the buyer. Where delivery fails for this reason, the Return & Refund Policy (Failed Delivery) applies: the Buyer is refunded the item price, and the first-leg shipping fee paid is not refunded.
Upon receipt of items, buyers must inspect them promptly and raise any disputes related to condition, authenticity, damage, or non-delivery within the timeframe specified in the Trade Policy. Failure to dispute within this period is deemed acceptance of the items and waives the right to claim compensation. Buyers who fail to comply with notification requirements or the Trade Policy may face account restrictions or suspension.
9. Seller Credit System
CardBuster operates a seller performance evaluation system that assesses seller reliability, response time, fulfillment accuracy, dispute resolution history, and customer feedback. Seller performance is reflected through a visible tier system that conveys seller reputation to buyers.
Seller tiers influence various platform privileges and features, including the visibility of listings in search results, priority in dispute resolution, access to promotional tools, and commission structures. Higher tiers confer greater visibility and benefits to reward consistent, reliable performance.
The complete details of the seller credit tier system—including tier structure, evaluation criteria, performance metrics, advancement and demotion requirements, and associated benefits—are set out in the Seller Credit Point Policy, which is incorporated by reference.
10. Limitations and Restrictions
You agree not to engage in any of the following prohibited conduct on or through CardBuster:
- Solicit, arrange, or conduct transactions outside of CardBuster to avoid paying fees or circumvent our terms and policies
- Use a false identity, impersonate another person, or provide false or misleading information
- Upload, post, or transmit content that is illegal, harmful, abusive, defamatory, obscene, hateful, or infringing of third-party rights
- Scrape, crawl, or automatically extract data from CardBuster without authorization
- Reverse engineer, decompile, or attempt to discover source code or internal systems
- Engage in harassment, bullying, or abusive behavior toward other users or CardBuster staff
- Send unsolicited messages, spam, or commercial solicitation
- Violate any applicable law, regulation, or third-party right, including intellectual property, privacy, or contract rights
CardBuster reserves the right to investigate and take lawful action against any violations, including account suspension, permanent termination, reporting to law enforcement, and civil litigation. You agree to reimburse CardBuster for all costs, damages, and fees—including legal fees—incurred in responding to or remedying your violations of these Terms.
11. Intellectual Property
All intellectual property in CardBuster—including but not limited to the website design, mobile application, logo, trademarks, source code, software, documentation, graphics, user interface, and all original content—is the sole property of CardBuster or our licensors. All rights are reserved.
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use CardBuster for your personal, non-commercial purposes only. This license does not permit you to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, or otherwise exploit any part of CardBuster without our prior written consent.
12. User Content
Any content you submit to CardBuster—including product descriptions, photos, reviews, ratings, comments, and feedback—is referred to as User Content. By submitting User Content, you grant CardBuster a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and sublicense the content in any media or format.
You represent and warrant that all User Content is accurate, truthful, original or properly licensed, and does not infringe any third-party intellectual property, privacy, or other rights. CardBuster is not obligated to post, display, or publish any User Content. We reserve the right to monitor, review, edit, and remove any User Content that violates these Terms or is otherwise harmful, misleading, or inappropriate.
13. Privacy
Your use of CardBuster is governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect, process, and use your personal information in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia. 14. Indemnity
You agree to indemnify, defend, and hold harmless CardBuster, its officers, directors, employees, agents, and affiliates from any claim, damage, loss, liability, or cost (including reasonable legal fees) arising from or related to:
- Your listings, offers, sales, or purchases on CardBuster
- Your breach or violation of these Terms
- Your improper or unlawful use of CardBuster
- Your violation of applicable law or third-party rights
- Your tax obligations and liabilities
CardBuster reserves the right to assume the exclusive defense and control of any indemnified claim and to settle it at its discretion, provided that you remain liable for the settlement amount.
15. Disclaimer of Warranties; Limitation of Liability
CARDBUSTER AND ALL SERVICES, CONTENT, AND INFORMATION PROVIDED THROUGH THE PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.
CARDBUSTER DOES NOT WARRANT THAT:
- The platform will be error-free, uninterrupted, or continuously available
- Defects will be corrected or that the platform is compatible with any particular hardware or software
- Any items listed are authentic, of merchantable quality, or fit for a particular purpose
- Results obtained through the platform will meet your expectations
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDBUSTER SHALL NOT BE LIABLE FOR:
- User content, actions, or disputes between users
- Unauthorized access, hacking, or third-party interference
- Viruses, malware, bugs, or technical errors
- Delays, non-delivery, or loss of data
- Account suspension or termination
- Actions of third-party payment processors, carriers, or logistics providers
LIMITATION OF LIABILITY: Except for claims related to indemnification obligations, your liability or CardBuster's liability arising under or related to these Terms shall not exceed the greater of (a) MYR 500, or (b) the total fees paid by you to CardBuster in the 12 months preceding the claim. Some jurisdictions do not permit the exclusion or limitation of liability; to the fullest extent permitted by applicable law, liability is limited as stated herein.
Any platform credits issued under the Return & Refund Policy are subject to the terms, conditions, and caps described therein. The issuance of a platform credit does not constitute an admission of liability or create an obligation to issue further credits.
16. Disputes with CardBuster
BINDING ARBITRATION AGREEMENT: Any dispute, claim, or controversy arising out of or relating to these Terms, CardBuster, or your use of the platform shall be resolved by binding arbitration and NOT by court litigation. This includes any claims arising from the Trade Policy, user disputes, payment failures, account suspension, intellectual property, privacy, or any other matter.
CLASS ACTION WAIVER: You agree to arbitrate only on an individual basis and waive any right to participate in class action, class arbitration, or representative action against CardBuster. This means disputes cannot be consolidated with other users' disputes or brought as a class claim.
Arbitration: Disputes shall be resolved through arbitration administered by the Asian International Arbitration Centre (AIAC) under its Arbitration Rules. The arbitration shall be conducted by a single arbitrator, in the English language, with the seat of arbitration in Kuala Lumpur, Malaysia.
Small Claims Exception: Claims valued at MYR 5,000 or less may be brought in small claims court instead of arbitration, at the claimant's election.
CardBuster shall pay the arbitrator's fees for claims valued under MYR 5,000. For larger claims, costs shall be allocated per the relevant arbitration rules.
Before commencing arbitration, the parties must attempt to resolve the dispute through informal good-faith negotiation for a period of 30 days. Written notice of the dispute must be provided to contact@cardbuster.com, clearly describing the issue and the relief sought.
Notwithstanding the above, CardBuster may seek preliminary injunctive relief or other equitable remedies in any court of competent jurisdiction to prevent irreparable harm, including breach of intellectual property rights or confidentiality obligations.
17. General Provisions
Entire Agreement: These Terms, together with all policies referenced herein (Privacy Policy, Trade Policy, Return & Refund Policy, Seller Fees and Charges, Condition Guide, Seller Credit Point Policy, and FAQ), constitute the entire agreement between you and CardBuster regarding use of the platform and supersede all prior negotiations, understandings, and agreements.
Language and Interpretation: These Terms are written in English and may be translated into other languages for reference only. In the event of any conflict between the English version and any translated version, the English version controls and prevails.
Severability: If any provision of these Terms is found by a court or arbitrator to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions shall continue in full force and effect.
No Waiver: CardBuster's failure or delay in enforcing any right or provision of these Terms does not constitute a waiver of that right. Any waiver must be in writing and signed by an authorized representative of CardBuster.
Assignment: CardBuster may assign these Terms or any right or obligation hereunder without notice or your consent. You may not assign these Terms or any right or obligation without CardBuster's prior written consent, and any attempted assignment is void.
No Partnership or Agency: Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency between you and CardBuster. You are an independent user and are not authorized to represent CardBuster to third parties.
Governing Law: These Terms and your use of CardBuster shall be governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles.
Electronic Communications: You consent to receiving notices, agreements, and other communications from CardBuster by electronic means, including email, SMS, or notifications within the mobile application or website. We may update these contact methods from time to time.
Mobile Application Terms: If you access CardBuster through our mobile application, you also agree to comply with the terms and conditions of the application platform (Apple App Store, Google Play Store, etc.) and any app-specific usage policies.
Notices: All legal notices or requests must be sent in writing to contact@cardbuster.com or to the registered address of CardBuster provided above. Notices are effective upon receipt.
Survival: The following sections survive termination of these Terms: Fees and Payment, Counterfeits and Fraud, Intellectual Property, Indemnity, Disclaimer of Warranties and Limitation of Liability, Disputes with CardBuster, and General Provisions.
